Yes this is the law in Pennsylvania. I know because I need med's to cover my spinal pain (3 fractured vertebra) permanent damage. I live in PA. Depending on the mood of the officer that comes in contact with you, you might be arrested by State & or Federal laws. Thats not the local jail, thats FEDERAL Prison. My Dr.'s will no longer (past 2 years) prescribe me meds that actually work (narcotics). I take high levels of gabapentin which actually will make a person feel higher than the THC in marijuana but for me do nothing for pain levels. What the Doctors Now Do is prescribe Medical Marijuana, it's their cure all drug of choice. I don't like being high and I don't drink alcohol (which is fine by the PA courts for people to use alcohol and carry a fire arm) which I believe is far far worse than smoking marijuana. For me, my decision in order not to be held at the mercy of the police, local & state & the courts, and be imprisoned, was to sell off my weapons. I can no longer defend myself and carry and have had the 2nd Amendment taken away from me. I can't even go to the firing range and fire my rifle. If I'm seen at the range I can be arrested on site. I've sold every gun I owned just to feel safe from the police and the PA government but must live in extreme pain every day. This is Pennsylvania taking away the 2nd Amendment from us who need medication to live day to day. I suppose I'm expected to become an alcoholic instead. Our governor lost my respect, its a cheap and sneaky gun ban. I can not defend myself & my family, if I do… I go to prison.

There is a clause under 27 CFR as 478.1 , which prohibits addicts and drug users from owning a firearm, that says ; " and any person who is a current user of a controlled substance IN A MANNER OTHER THAN AS PRESCRIBED BY A LICENSED PHYSICIAN. . . " . My question is, if a doctor prescribes medicinal marijuana to you then how can they clump you in with addicts and drug abusers who shouldn't own a firearm ? Next they will tell you that because you broke your leg and we have to prescribe you some pain meds, so you have to turn your gun in at the pharmacy when you pick up your drugs.

As a recently disgruntled 30 year plus NRA endowment member, and as someone who personally knows veterans with PTSD as well as MS patients who’ve had their 2nd Amendment rights summarily denied simply because they were issued medical marijuana cards by their doctors, this issue drives me absolutely nuts.. The NRA, who's motto is "freedom first", has been suspiciously silent on this entire issue, which is something that I personally consider a de facto NRA endorsement of this current marijuana/2nd Amendment denial policy.. The Trump administration, which won several formerly blue states in part because of a strong pro 2nd Amendment platform, supports this anti-gun Obama instigated DOJ policy as well.. The "public safety" nature of this issue is nothing but a red herring, and it's being used as an excuse to deny an unalienable natural right to American citizens that "shall not be infringed".. IMO the primary reason for this is just so big pharmaceutical lobbies can continue to push their products without any competitive alternative medications for chronic pain, PTSD, etc being allowed by our federal government, and it’s really no more complicated than that!.. The current Washington DC pseudo outrage over the opioid epidemic, while simultaneously refusing to legalize medical marijuana, is the epitome of political hypocrisy.. It’s also important to note that the 2nd Amendment is the ONLY right in the Bill of Rights that can be summarily denied without the benefit due process as well.. As of now, the Trump Administration is on the record for having sided with the insanely ant-gun 9th Circuit Court.. And unless something gives, the Administration will apparently be soliciting the SCOTUS with their "public safety" nonsense, something that I'm sure Justices Sotomayor, Ginsburg, Stevens, and Kagen will rule in favor of.. Hopefully though, Thomas, Gorsuch, Alito, Kennedy, and Roberts, will see past this political cash inspired charade and right this wrong once and for all.. A proper Court ruling will NOT legalize marijuana at the federal level as this is still arguably a states rights issue..However, the SCOTUS needs to immediately halt the unconstitutional denial of any and all natural unalienable rights posthaste!..
What about people on opiates, when abused I have seen some crazy violence just to obtain the drug. MMJ has a very calming effect. I just don't see this being a problem unless drug dealers are involved. It is quite a process to get MMJ as well as the state of Fl is not allowing you to smoke. It is truly medication and the people that do get it need it. Don't think being very ill and use of MMJ is going to cause an epidemic of randomly sick people start running around shooting. I know that it is illegal to be in possession of a firearm when intoxicated, so obviously it's a no-no with marijuana. In fact, it's worse since it's a schedule 1 substance, whereas alcohol isn't even registered.
