An Oklahoma man will serve five years in prison for felony distribution of marijuana following sentencing in Labette County District Court on Wednesday.
Jeremy S. Henshaw, 33, of Vinita, Oklahoma, was arrested Feb. 18, along with Jeffery J.W. Adams, 23, and David E. Lee, 48, following a car chase that began in Oklahoma and ended when they crashed in Chetopa.
The occupants in the gray Buick were suspected of brandishing firearms at a motel in Vinita.
Oklahoma authorities were involved in the car chase and Chetopa police joined the chase near 2000 Road on U.S. 59. The Chetopa officer clocked the Buick at 100 mph northbound on U.S. 59 heading to Chetopa and pursued. The vehicle turned east on Plum at least at 50 mph and turned south on Willow, which dead ends at Cherry Street. The Buick’s driver could not stop at Cherry. The vehicle left the road and struck trees. Henshaw and Adams left the vehicle. Lee surrendered. Henshaw and Adams were later found and arrested.
A Chetopa police officer smelled marijuana in the vehicle and saw on the driver’s floorboard a large scale and a container that appeared to have a white crystalline substance in it, according to the affidavit.
A search of the vehicle turned up drug paraphernalia, 9 mm shells, three large bags of marijuana weighing more than 10 pounds and an AR-556 rifle with two 30-round clips.
The officer found the marijuana to be packaged for sale, the affidavit said. Some marijuana was in jars and in larger bags.
All three men were charged in Labette County District court with distribution.
All three were also charged with possession of methamphetamine, a felony, and possession of drug paraphernalia, a misdemeanor.
Henshaw reached a plea agreement June 1.
Judge Steve Stockard noted he had quite a significant history with drugs and guns, but he went with the agreement’s recommendation. Henshaw was found guilty in count one, distribution of marijuana, a level 3 drug felony, and count two, possession of a firearm by a felon.
On count one, Henshaw was ordered to serve 60 months in prison with 20% max good behavior time, followed by 36 months post release supervision and was ordered to pay court costs totaling $938.
On count two, Henshaw was given eight months to run concurrently, and 12 months post release supervision.
Despite wearing leg irons, Henshaw attempted to do a little dance in his orange jumpsuit on his way out of the courtroom.
