It's illegal to buy, have and produce because the govt doesn't want you to have it. But it's legal to consume so that you can go to a rehab center without becoming a criminal. If it was illegal to consume everybody who went there would be arrested and guilty of consuming because therapists would be legally obliged to report your confession to the authorities
The situation is similar in my country, you can't buy, sell, have or produce it, but consumption itself can't be made illegal because admitting to consume would be confessing a crime for anybody who wanted to seek help
