  1. For the people that don't like the result, the fault is not on the lawyer, the fault was the police officer's illegal actions. The officer could've done this legally, which would've required more work, but the officer took the easy way out and now the charges can't stick. Police officers know this but some do it anyway.

  2. So wait a second, let me ask a question here. Let's suppose there's a situation where the discovery body cam footage doesn't show an integral piece of evidence in defense of the defendant (plaintiff being some city) that defendant and others present on the scene the day of arrest has in affidavit form stated should exist, assuming no evidence tampering of course ( they were witness to the verbal back and forth between the police and defendant so they themselves have knowledge of portions missing from said footage ). When reviewing the discovery footage there were edits made to the recording to chop away important pieces that turns it to a my word against theirs scenario so here's the question: There's a way to subpoena that lost footage stated by numerous people should be on recording but didn't receive? If so, what if that isn't available? Does that show evidence tampering on the part of the officer in question? Jw

  3. I always hate to see an actual Criminal get away with a crime. I also believe that the vast majority of gun laws are unconstitutional. All that said, it's becoming more and more clear that more and more often the criminals that are getting away with crimes are wearing a badge and uniform. We look the other way because of the greater good, and we allow a cop to break the law in order to bring in a criminal, and the next thing you know it's not just criminals they're bringing in. It's unconscionable the amount of innocent people that get charged with crimes, and literally robbed on the side of the highway by Bad Cops I never would have dreamed that this problem could become so pervasive, but it's to a point that I tend to distrust all cops, which is unfair, but that's the bed they have allowed to be made.

  4. So sections of the video/audio were "missing"…. I wonder if they were 'missing' on purpose because they were useful to the defence… which is called a Brady violation if I am correct in my understanding of US law.
    Question… how many cops have ever been done for a Brady violation?? I'm gunna say basically none, am I right?

  5. 9:50 ish If they didn't provide all records as required by Motion for Discovery, should be grounds for case dismissal. Why did you allow them to continue and only provide discovery later and only as specifically requested by you? Was the judge allowing them to not following rules of evidence?

  6. I have been watching a few traffic stops on youtube and the main way police get into a vehicle is by stating they smell pot from their position when the window is opened. If the officer lies I really don't see a way to fight this. Even if they don't find anything related to pot in their search they can always say the smell came from previous smoke. There's no way to prove this lie after the fact. In your case the only reason your client got off was because the officer had a previous record of related bad behaviour. So really the police can search any vehicle they want any time they want by using this tactic.
